GENERAL
Contracts are made and accepted subject to these Conditions of Sale, and are governed by English Law and no other.
In these Terms and Conditions “the Company” means DOT com SYSTEMS, “Customer” means the person named as customer overleaf, “Contract” means the contract for the sale by the Company to the Customer of the Goods constituted by these terms and conditions.
QUOTATIONS
All prices stated include VAT, unless expressly stated otherwise.
Firm price quotations are valid for a period of one month, unless expressly stated otherwise, after which time they may be subject to alteration.
Where quotations are based on details provided by the Customer, such quotations are subject to that information.
The Company may at their absolute discretion accept or reject any order placed by the Customer.
AVAILABILITY
As we regularly update our product range, continuity of supply cannot be guaranteed. We do not accept responsibility for any subsequent changes in the design, style or specification of products to those previously supplied.
PAYMENT
Payment is requested in full at the time that goods are taken away from the premises of the Company, unless an agreement has been made to the contrary.
If a customer is purchasing a complete computer system that requires the installation of an operating system, the customer is required to pay a non-refundable deposit amounting to the cost of the operating system.
CANCELLATION
If the Company accepts a cancellation of an order or part thereof, the Company reserves the right to charge the Customer with the amount of any losses or expenses incurred as a result of such cancellation. The Customer may therefore be liable to pay the Company up to 20% of the price of the Goods, and this will be deducted from any deposit or advance payment paid by the Customer.
RISK AND LIABILITY
Risk and liability for any loss of and damage to the Goods of whatever nature shall pass to the Customer on collection or at the time of delivery.
OWNERSHIP
Ownership of the Goods shall remain with the Company and shall not pass to the Customer until the agreed price for them has been paid in full.
WARRANTIES AND LIABILITIES
The Company provides a 12-month back to base warranty on all hardware purchased with the exception of: -
During the 12-month warranty period, the Company shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, damage arising from adverse weather conditions (such as thunderstorms) failure to follow the Company’s instructions (whether oral or in writing) misuse or alteration or repair of the Goods without the Company’s approval.
SOFTWARE
The Company strongly recommends the use of AntiVirus Software, and shall be under no liability in respect of any damage arising from computer viruses and/or any malicious scripts.
It is the Customer’s responsibility to ensure that any software that is loaded on to their computer once it has left the Company’s premises, is compatible with the installed Operating System.
Should problems arise as a direct result of the use of unsuitable software and/or downloads from the internet, the Company will attempt to rectify the situation, however labour will be chargeable, together with any repairs and/or replacement of hardware.
All software and instruction manuals provided by the Company should be kept in a safe place as they may be required should any problems arise with the Goods.
BACKING-UP
The Company strongly recommends that Customers regularly back-up any information (for example, documents, photographs, music, etc) that is stored on the hard disk drive, whether it be on a CD, DVD, memory stick, external hard drive, on cloud based storage or any other storage device.
OTHER RECOMMENDATIONS
The Company recommends that Customers, who have access to the Internet, keep their software and hardware regularly updated. In this respect, Customers should subscribe to automatic Windows Updates with Microsoft ©, and periodically check on their hardware manufacturer’s websites to determine whether firmware and/or software updates are available. These updates can normally be found in the Support section of websites.
The Company strongly recommends that Customers should unplug their computers, printers, scanners and any other electrical items when away on holiday and if electrical storms have been forecast, in order to reduce the risk of unnecessary and costly repairs that may be caused by sudden power surges.
